The teams that pass audits in 2026 are the ones that can produce a logged metric, a versioned policy, and an incident response trail. The teams that fail are the ones that only have a written policy.
The EU AI Act in operational terms
The EU AI Act assigns AI systems to four risk tiers. The first is prohibited, which includes things like social scoring by public authorities and untargeted scraping of facial recognition databases. The second is high-risk, which covers Annex III use cases such as employment screening, credit scoring, biometric identification, and access to essential services. The third is limited-risk, which mainly triggers transparency obligations such as disclosure that a user is interacting with AI. The fourth is minimal-risk, which has no specific obligations beyond voluntary codes.
For most enterprise teams, the practical work in 2026 is in the high-risk tier. The obligations include risk management, data governance, technical documentation, record-keeping, transparency, human oversight, accuracy and cybersecurity, and post-market monitoring. The post-market monitoring obligation under Article 72 is the one most teams underestimate, because it requires continuous monitoring with documented metrics and incident response. That is a tooling problem, not a policy problem.
The penalties scale to global turnover: up to 35 million euros or 7 percent for prohibited-system violations, up to 15 million euros or 3 percent for high-risk non-compliance, and up to 7.5 million euros or 1 percent for incorrect or misleading information to authorities.
GDPR for GenAI: the parts that actually bite
GDPR does not disappear because the AI Act is in force. It applies in parallel. Three articles do most of the work for GenAI compliance.
Article 22 limits “decisions based solely on automated processing, including profiling, which produces legal effects” without explicit consent, contractual necessity, or specific legal basis, plus a right to human review. In practice that means any AI-driven hiring decision, loan decision, or insurance decision needs a documented human-in-the-loop or an explicit lawful basis. The recent European Court of Justice case law on Article 22 (most notably the SCHUFA decision in late 2023) read the provision broadly, so the conservative interpretation is now standard.
Article 25 requires data protection by design and by default. For GenAI that translates into minimization of training data, purpose limitation, and technical controls to prevent leakage of training data through model outputs.
Article 35 requires a Data Protection Impact Assessment for processing that is likely to result in high risk to rights and freedoms. For GenAI, a DPIA is typically expected for consumer-facing or employee-facing systems that involve consequential decisions, sensitive data, systematic monitoring, or profiling. The DPIA documents the processing, the risks, and the mitigations, and is the artifact regulators ask for first.
CCPA, CPRA, and the US state patchwork
The CCPA, as amended by the CPRA, gives California consumers rights to know, delete, correct, opt out of sale and sharing, and limit use of sensitive personal information. For GenAI the most operationally significant rules are the emerging right to opt out of automated decision-making technology (the California Privacy Protection Agency has been progressing ADMT rulemaking and has issued draft regulations through 2024 and 2025) and the obligation to honor opt-out signals like the Global Privacy Control.
Several other US states have meaningful AI rules. Colorado’s AI Act focuses on high-risk AI systems and requires impact assessments for systems used in consequential decisions. New York City’s Local Law 144 governs automated employment decision tools. Illinois has biometric privacy rules through BIPA that catch many face and voice features. The pragmatic approach is to treat the strictest state rule that applies to your user base as the floor.
Sector-specific rules: layering, not replacing
Sector rules apply on top of the horizontal AI and privacy laws.
In healthcare, HIPAA continues to require encryption, access controls, and breach notification for protected health information. The FDA framework for software-as-a-medical-device governs diagnostic AI; the FDA’s 2024 AI/ML-enabled device list is the practical reference for what classifications and clearances look like.
In finance, the Fair Credit Reporting Act governs credit-related decisions and requires reasoned explanation of adverse actions. The Federal Reserve’s SR 11-7 supervisory guidance covers model risk management for banks. The Equal Credit Opportunity Act prohibits discriminatory lending models. In 2023 and 2024 the federal banking agencies clarified that these existing rules apply to AI used in covered decisions.
In education, FERPA governs student record privacy. COPPA governs the collection of data from users under 13, which catches most K-12 AI tutoring tools.
The compliance framework needs a sector module per regulated domain you operate in, with controls mapped from the horizontal layer to the sector-specific evidence requirements.
Building the framework: four steps that work
Step one is inventory. List every AI system, including third-party AI used through your vendors. For each one capture the use case, the data flows, the model and provider, and the human owner. The inventory is the artifact that everything else hangs off.
Step two is classification. For each system in the inventory, assign an EU AI Act risk tier and a sector classification where relevant. The classification drives the controls: a high-risk system needs more than a limited-risk system. Document the classification reasoning, because regulators ask.
Step three is the control library. Build versioned policies for data governance, model validation, evaluation, observability, runtime guardrails, human oversight, and incident response. Map each control to one or more regulations.
Step four is the evidence pipeline. Logged evaluator scores, traces, guardrail events, audit trails, and incident records. This is the tooling problem most teams underestimate. The evidence is what proves the controls are working.
Technical controls: where evaluators and traces become evidence
For 2026 audits, the technical control conversation centers on three artifacts.

The second is the trace. traceAI is Apache 2.0 and ships framework-specific instrumentors including traceai-langchain exposing LangChainInstrumentor, plus traceai-openai-agents, traceai-llama-index, and traceai-mcp. Every model call, every retrieval, and every evaluator score becomes a span, and the spans are queryable.

The two required environment variables are FI_API_KEY and FI_SECRET_KEY. Hosted evaluators in the managed surface run on three tiers: turing_flash at roughly 1 to 2 seconds, turing_small at 2 to 3 seconds, and turing_large at 3 to 5 seconds.
The third is the runtime guardrail with policy versioning. Vendor due diligence: the part that surprises teams
The EU AI Act assigns obligations across the value chain: providers (who build and place the system on the market), deployers (who use it), importers, and distributors. If you use a third-party model, you are likely a deployer, with obligations that include monitoring the system in your deployment context.
That means a vendor questionnaire and a contractual addendum are not enough. You need to be able to demonstrate that your deployment-side monitoring is producing evidence that the system continues to operate within the provider’s intended purpose. In practice that is the same evaluator-and-trace pipeline you would run for an in-house model, applied to the third-party output.
Human oversight and incident management
Article 14 of the EU AI Act requires effective human oversight for high-risk systems. In operational terms that translates into named reviewers with the authority to override, the time and tooling to do so meaningfully, and a logged review record. A reviewer who only sees automated decisions after the fact is not effective oversight.
Article 73 requires reporting of serious incidents to authorities within deadlines that range from immediate notification to 15 days depending on the severity. The incident log needs to be machine-readable, time-stamped, and connect each incident to its detection signal, response action, and resolution.
Common compliance failures in 2026
Five failure modes show up across audits.
The first is undocumented training data lineage. If a regulator asks where the data came from and you cannot answer, the rest of the framework is less convincing.
The second is unclassified shadow AI. Teams adopt third-party tools without informing the compliance function, and the system never enters the risk register.
The third is post-market monitoring without evidence. The policy exists, but there is no logged metric history to prove the monitoring happened.
The fourth is human oversight on paper only. The role exists, but the reviewer never sees enough information to override and there is no record of overrides occurring.
The fifth is incident response that does not flow into the audit trail. The incident gets resolved, but the resolution is not connected to the original detection.
Looking ahead to 2027
Three trends will shape the 2027 conversation.
First, the high-risk system obligations finish phasing in by 2 August 2027 for components of regulated products. The compliance posture you build in 2026 is the one that has to operate under full AI Act obligations from 2027 onwards.
Second, the Codes of Practice for general-purpose AI being developed under the European AI Office will translate AI Act principles into operational guidance, and the harmonized standards will follow. Expect more granularity in 2027.
Third, US state laws will continue to layer. The strictest applicable state rule will continue to be the practical floor for US-only deployments.
Putting it together
A GenAI compliance framework in 2026 is an operational system, not a policy document. The four steps (inventory, classification, controls, evidence) and the seven pillars in the TL;DR table are the practical structure.
